Term: GameStop Family Night In Sweepstakes ("Sweepstakes") begins on June 22, 2009, at 9:00 a.m. Central Daylight Time (CDT) and ends on September 1, 2009, at 5:00 p.m. CDT ("Term"). Entries will be divided into separate weekly entry periods, as described below in the section titled “Winner Selection”.
Eligibility: Sweepstakes is open to legal United States residents, including the District of Columbia, who are at least 18 years of age and above the age of majority in the jurisdiction in which they reside at the time of entry. Void in Guam, Puerto Rico and where prohibited by law. Employees of GameStop Inc., its affiliated companies, companies involved in the development and implementation of the Sweepstakes, and members of the immediate families and residents of the same households of each are not eligible. Sweepstakes is subject to all local, state and federal laws and regulations. By entering this Sweepstakes, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations.
How to Enter: There are two ways to enter the Sweepstakes:
(A) Online: During the Term, go to
http://www.gamestop.com/familynightin, follow the instructions on how to enter the sweepstakes, and submit your entry so it is received by Sponsor’s server no later than September 1, 2009 at 5:00 p.m. CDT. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. By entering, participants acknowledge compliance with the Official Rules, including eligibility requirements and agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding. The use of any device to automate the entry process is prohibited. Illegible or mechanically reproduced entries are not eligible. All entries and requests become the Sponsor’s property and will not be returned or acknowledged. The Sponsor is not responsible for lost, late, damaged, incomplete or misdirected entries.
(B) Alternate Method of Entry - Mail-in Entry: Please hand print your name, complete address and phone number (including area code) and age either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mail the postcard or paper in an envelope with the proper postage affixed to: GameStop Family Night In Sweepstakes, PMI Station, PO Box 3514, Southbury, CT 06488-3514. All entries must be post marked no later than September 1, 2009 and received no later than September 8, 2009. Entries must be mailed separately. All entries and requests become the Sponsor’s property and will not be returned or acknowledged. Illegible entries are void. The Sponsor is not responsible for lost, late, damaged, incomplete, misdirected, mutilated, postage due, or entries not received in time for drawings. To be eligible for a particular weekly drawing, mail-in entries must be postmarked during the weekly entry period and received prior to the drawing date; see below for weekly entry periods and drawing dates.
Limit one entry per person/email address, per weekly entry period, regardless of method of entry.
Winner Selection: On each of the following Drawing Dates, and independent judging organization will select ten (10) winners via random drawing from among all eligible entries received for the corresponding Weekly Entry Period.

Weekly entry periods change at midnight CDT. Entries will not be carried forward into subsequent weekly drawings. To be eligible for a particular weekly drawing, mail-in entries must be postmarked during the weekly entry period and received prior to the drawing date.
Potential winners will be contacted by mail at the address provided with the entry. Inability to contact a winner or the return of any prize as undeliverable will result in the prize being forfeited. Prizes will be fulfilled within 2-4 weeks of the corresponding drawing date. All decisions of the Sponsor and independent judging organization are final. Sponsor reserves the right in its absolute and sole discretion to substitute any prize of equal or greater value.
Prizes: Sponsor will award one hundred (100) Prizes (ten (10) for each weekly entry period), each prize consisting of one (1) $25 American Express® Gift Card, Approximate Retail Value (“ARV”) $25, one coupon redeemable for a Baskin-Robbins® Brownie a la Mode Cake (ARV $14), and four (4) Twix® singles (ARV $3.50). The total ARV of all prizing is $4,250. There is no cash substitute and prizes cannot be redeemed for cash. No more than the stated number of prizes will be awarded. Any third party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third party trademarks in these Official Rules or in the Sweepstakes is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Sweepstakes.
Prize Restrictions: Limit one (1) prize per individual/household. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should a prize become unavailable for any reason. Taxes and any costs associated with the receipt of a prize are the responsibility of the winner. By accepting any prize, winners consent to use of his/her name or likeness for advertising/publicity purposes without further consideration, except where prohibited by law. If for any reason the Sweepstakes is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, modify or terminate the Sweepstakes.
Privacy: Any information collected will be subject to Sponsor’s Privacy Policy, located at http://www.gamestop.com/gs/help/PrivacyPolicy.asp (The "Policy"). By entering the Sweepstakes, you acknowledge that you have agreed to the Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this Sweepstakes in accordance with the Policy. If you wish to access or correct your personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions regarding our privacy policy, please contact us at help@gamestop.com.
Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor web site; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Release and Limitation of Liability: By entering, participants release and hold harmless Sponsor, its affiliated companies, companies involved in the development and implementation of the Sweepstakes, together with the respective parents, subsidiaries, affiliates, directors, officers, employees and related entities of each (collectively, "Releasees") from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, use, or misuse of a prize from or arising out of participation in this Sweepstakes. Sponsor assumes no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participants or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes; (4) technical or human error which may occur in the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or receipt or use or misuse of any prize.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of god, hurricane, war, fire, swine flu, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
Disputes: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
